Terms of Service

1. Overview

These Terms govern your use of the SkinTech Jobs website and any related apps or services (the “Services”), operated by SkinTech. By creating an account, browsing job listings, or otherwise using the Services, you agree to be bound by these Terms.

2. Binding agreement and changes to these Terms

These Terms form a binding agreement between you and SkinTech Jobs. We may update these Terms from time to time; where a change materially affects your rights, we'll give reasonable notice (for example, by email or an on-site notice) before it takes effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.

3. Registration and accounts

You must be legally capable of entering into a contract to register. You can register as a candidate or an employer. You agree to provide accurate, current, and complete information when you register and to keep it up to date. Candidates may register from New Zealand, Australia, the Pacific Islands, the Philippines, or Thailand. Job listings themselves are limited to New Zealand and Australia.

4. Password and account security

You're responsible for keeping your login credentials confidential and for all activity that occurs under your account. Tell us immediately if you suspect unauthorised use of your account.

5. Intellectual property

SkinTech Jobs and its licensors own all rights, title, and interest in the Services, including the site design, branding, and underlying software. Nothing in these Terms transfers any of that intellectual property to you. Section 10 below covers ownership of the content you submit.

6. Availability of the Services

We aim to keep the Services available and functioning correctly but don't guarantee uninterrupted or error-free access. We may suspend, withdraw, or restrict access to all or part of the Services for maintenance, updates, or reasons outside our control.

7. Acceptable use

When using the Services, you agree not to:

• Post content that is false, misleading, unlawful, or discriminatory on the basis of a protected characteristic (including race, ethnicity, national origin, age, sex, or disability) under New Zealand or Australian law;
• Scrape, harvest, or extract data from the Services using automated tools, except where we've explicitly permitted it;
• Use the Services to collect candidate or employer data for purposes unrelated to genuine recruitment;
• Impersonate another person or misrepresent your affiliation with a business;
• Attempt to circumvent our payment system for paid listing tiers;
• Interfere with the operation of the Services or attempt to access accounts or data that aren't yours.

8. Additional terms for candidates

Creating a candidate profile lets employers view your details and consider you for roles you apply to. You don't acquire any ownership rights in the Services by creating a profile. You can delete your account at any time from Settings; we'll remove your profile from active search but may retain records where we're required to by law (for example, payment or dispute records tied to your account).

9. Additional terms for employers and job ad standards

Employers are responsible for the accuracy of their listings, including pay, location, and work-eligibility requirements. Right-to-work and visa sponsorship information shown on a listing is supplied by the employer; SkinTech Jobs does not verify immigration status and is not a party to any employment relationship formed through the Services. It remains each employer's legal responsibility to confirm a candidate's right to work before employment begins. We may refuse, remove, or request changes to any listing that breaches these Terms or applicable law.

10. User content and submissions

You retain ownership of the content you submit (job listings, profile information, portfolio images, resumes, cover notes). By submitting content, you warrant that you have the right to do so and grant us a licence to display, host, and reproduce it for the purpose of operating the Services. We may remove content that breaches these Terms.

11. Suspending or cancelling your account

We may immediately suspend your account for unlawful conduct or serious breaches of these Terms. For other breaches, we'll generally give you notice and a reasonable opportunity to fix the issue before suspending or cancelling your account.

12. Paid listings

Featured and Urgent listing tiers are paid upgrades processed through Stripe. Prices are shown in NZD at the time of purchase. Paid upgrades are non-refundable once the listing has gone live, except where required by law.

13. Our liability

SkinTech Jobs provides a venue connecting candidates and employers; we're not a party to, and don't guarantee the outcome of, any employment relationship formed through the Services. To the maximum extent permitted by law, we exclude liability for indirect or consequential loss, and our total liability arising from your use of the Services is limited to the amount you've paid us in the 12 months before the claim arose (or NZD 100 if you haven't made any payments).

14. Disclaimers

The Services are provided “as is”. We don't guarantee that any job listing will result in a hire, or that any candidate profile will result in an offer. We aren't responsible for the accuracy of content submitted by other users, or for service interruptions or data loss outside our reasonable control.

15. Third-party websites

The Services may link to third-party websites (for example, an employer's own website). We don't control and aren't responsible for the content or practices of those sites.

16. Indemnity

You agree to indemnify SkinTech Jobs against claims, losses, or costs arising from your content, your breach of these Terms, or your misuse of the Services.

17. Governing law

These Terms are governed by the laws of New Zealand, and any dispute will be subject to the non-exclusive jurisdiction of the New Zealand courts.

18. Miscellaneous

If any part of these Terms is found unenforceable, the rest continues to apply. Our failure to enforce a provision isn't a waiver of it. You can't transfer your rights under these Terms without our consent; we may transfer ours as part of a business transfer.

• Employer — a user registered to post jobs and review applicants.
• Services — the SkinTech Jobs website and related functionality.
• User Content — any content a user submits, including job listings, profiles, resumes, and portfolio images.
